There are some weeks when I get a good handful of serious health and fitness news – which usually doesn’t make it into the “mainstream” media.

When this happens – I feel an obligation to share it with you – so you are informed and “in the know”.

1 – Court upholds $48 million damage award against dubious infomercial scam artists

In 2008, the U.S. District Court for the District of Massachusetts found that Donald W. Barrett, Robert Maihos, and their two companies had deceptively claimed Supreme Greens and Coral Calcium could treat, cure, or prevent cancer, heart disease, diabetes, arthritis and other diseases.

In 2009, the court ordered Barrett, Maihos, and their two companies-Direct Marketing Concepts, Inc. and ITV Direct, Inc.-to pay $48.2 million. The district court also barred them from making unsubstantiated claims about any health product or billing consumers or charging their credit or debit cards on an ongoing basis without their consent.

2 – Detox footpad (Kinoki) marketers curbed

A federal judge has approved a stipulated agreement under which the marketers of Kinoki Foot Pads-Yehuda Levin and his company, Xacta 3000, Inc.-are barred from promoting or selling any dietary supplement, food, drug, or medical device, and from helping others do the same.

3 – FDA proposes new tobacco warning strategy

The Family Smoking Prevention and Tobacco Control Act gives the FDA the authority to regulate the manufacture and marketing of tobacco products. The act requires that the warnings occupy at least the top half of the panels front and rear panels of each cigarette package and at least 20% of all cigarette ads.

Some of the proposed WARNING statements are:

- Cigarettes are addictive.
- Tobacco smoke can harm your children.
- Cigarettes cause fatal lung disease.
- Cigarettes cause cancer.
- Cigarettes cause strokes and heart disease.
- Smoking during pregnancy can harm your baby.
- Smoking can k ill you.
- Tobacco smoke causes fatal lung disease in nonsmokers.
- Quitting smoking now greatly reduces serious risks to your health

4 – Federal agencies blast new breed of caffeinated alcoholic beverages

Caffeinated alcoholic beverages (CABs) combine alcohol, caffeine, and other stimulants and usually have higher alcohol content than beer. The caffeine content is usually not reported. During the past four months, consumers in at least four states were hospitalized after using CABs. This week, the Federal Trade Commission sent warning letters to four CAB marketers.

5 – Egg Whites or Whole Eggs: Which are Best for You?

I used to be shocked at how many people still follow an “egg white” diet when it comes to including eggs in their nutrition plan. Now I just shake my head – because I know some of the hardest myths to bust are some of the simplest and silly-est ones.

The “egg white” myth got it’s roots from the bodybuilding/gym-trainer circles, way back when…

Crazy thing is – all the reasons for chucking the yolks are absurd because that’s where all the really valuable elements are….

Fitness Program Success: How to Measure Fitness Progress & Success

Fitness goals come in many forms and definitions. Take a group of twenty people, ask them what their fitness goals are and you’ll get twenty different answers. There may very well be some close similarities between a good number of those fitness seekers – but then again, what means ‘tone up’ to one person may mean something totally different to another. But regardless of the many different individual versions of fitness goals, we can safely and confidently put them into several general categories that can hold the various subcategories and meanings as implied or inferred by the end user.

To keep matters simple, I will list the broadest terms that encompass the majority of fitness goals as applied to the general population.

1) Fat loss/Weight loss
2) Muscle ‘Toning’
3) Strength Building
4) Muscle Building
5) Energy Enhancement
6) Body Shaping (Re-shaping)/Body Sculpting
7) Flexibility Improvement
8) Reduction in Aches & Pains
9) Improved Self-Image & Self-Confidence
10) Improved Health/Medical Profile
11) Cellulite Reduction and Flab Lifting

There is definitely some overlap between these terms not only in definition but also in practice. But, this is a good thing – not a bad thing, at all – reason being that you can only get improvement in some of these areas if you are getting improvements in some of the others. Now, we are probably getting into an area of discussion more suited for fitness pros as opposed to fitness seekers but I think you are getting the idea of where I am coming from.

Are You ‘Hot’ or Not

Optimal fitness is not defined by one parameter – but rather by at least several. In other words, having a ‘hot body’ does not define one as fit – but having a hot body, that is flexible and capable of a moderate amount of physical output – which is fed a well rounded, nutrient dense diet will most likely fall into the ‘healthy and fit’ category.

On the flipside of this, having a body that is not defined as ‘sexy’ or ‘hot’ by societal norms does not mean that the ‘owner’ of that body is ‘unhealthy and unfit’. Remember, fitness is not defined by whether or not you can elicit cat calls and get yourself ‘checked out’ by others around you. Rather, fitness is a ‘full package deal’. It should answer the question: ‘What are we as a whole?’ when we account for all factors. Ultimately, it’s ‘how we feel about ourselves, with all elements of fitness being taken into consideration’.

So, where am I going with this slightly philosophical tilt? Well, the actual measurement of fitness progress and success can take many forms when we talk about specifics, but when the smoke clears and its time to assess ones changes and improvements – there are several elements to measure, depending on your personal goals, that will tell a tale and provide all the feedback needed to let you know if you are on the right track or in need of fitness/nutrition program adjustments.

You Already Have What You Need to Succeed

One of these key elements is your own intuition – you should be able to ‘feel’ if you are making progress or not. While there is nothing wrong with body-fat testing, weekly weigh ins, or strength testing (just to name a few)… It is more important that you start to rely on your internal feedback system. You want to learn how to get in tune with your body and your self. The better you get at this – the EASIER it becomes to ’stick with your program’, to make gradual progress… and to make your fitness lifestyle ‘SECOND NATURE’ to you.

OK – First here’s what happens next week (this is mostly for the

The official opening of the ‘Butt Specific’ program will be on
Tuesday. We’ve been getting tons of emails asking when this program
is being released. And I know I’ve been talking about this for a
VERY long time – but trust me – whoever takes advantage of this
program will quickly realize how “worth the wait” it was ;-) )

Body Enhancement’ Priority List yesterday – its after my PS at the

Second – In 2 weeks (March 11th) I’m having my tonsils removed, so
I may be lying low for about a week or two – so don’t worry if
you don’t hear much from me until the week after. (send me love,
get well fast wishes, fruit baskets, etc.. as I HATE being ‘off my
feet’… – drives me crazy)

Third – both the men AND women will like this one… (I may have
mentioned a little bit about this already) As of 2 weeks ago I
have a home & health club gym unit that is PATENT PENDING. This unit
is based on my methods and programs – so it is unique and will
most likely be patented – but that’s only the beginning…

I am bringing this unit to market – with or without a patent – it
doesn’t matter either way. It is ideal for family use, as all of the
exercises are body-weight and band type exercises – and there is
a great deal of adjustability.

More importantly – I will also be offering training programs with the
unit – which is something you do not see in the mainstream fitness
equipment offerings.

The first one is being built for our home right now – and we will then
begin scaling up production and marketing via the internet. These
units (I wish I could share the name – but we have to wait!) are
being made in the USA – and will carry a LIFETIME WARRANTY – yes
you heard that correctly.

There’s more to tell – but it will have to wait a few weeks. I want
to make note – this concept has been in development for over 2 years
and someone recently ‘challenged’ me to make it a reality – so now
I am.

Also – in conjunction with this unit – I’m filing a patent application
for a smaller unit, specifically made for women – who are devout
followers of my ULBHTM program (and/or the soon to be released ‘Butt
Specific’ program) – This unit not only eliminates the need for
trying to use things around your house, and a ball, and steps – but
it also allows you to add a whole new dimension to all your ‘Trouble
Spot’ areas and the rest of your home fitness needs.

OK – I have a mountain of work to get done with all these exciting
projects that we are working on – and my ‘tonsillectomy’ coming up
next week…

Anti Cancer Foods: Stay Fit for Life by Eating Cancer Fighting Vegetables

Not only aren’t Americans eating enough vegetables, but when it comes to combating cancer we’re eating the wrong ones. Researchers who tested extracts from 34 different vegetables against eight types of tumor cells report that the least popular vegetables in the US diet—such as broccoli and Brussels sprouts—pack the greatest anti-cancer potential. The veggies we prefer—potatoes, lettuce, tomatoes and carrots, which together account for about 60% of US adults’ vegetable consumption—may have their virtues, but prove less effective in cancer protection.

Writing in the journal Food Chemistry, Dominique Boivin from Quebec University and colleagues explained, “Epidemiological studies have consistently linked abundant consumption of fruits and vegetables to a reduction of the risk of developing several types of cancer. In most cases, however, the identification of specific fruits and vegetables that are responsible for these effects is still lacking.

”So the researchers put the produce aisle to the test in the lab. Extracts from cruciferous vegetables, a group that includes broccoli, kale, cauliflower, Brussels sprouts and cabbage, significantly inhibited the growth of all the types of tumor cells (stomach, lung, breast, kidney, skin, pancreas, prostate and brain). Also effective were extracts from vegetables in the botanical genus Allium, which includes garlic, onions, leeks and shallots. But these cancer-fighting vegetables make up only a “minuscule” part of the typical diet, the researchers noted.

The more popular potatoes, lettuce, tomatoes and carrots generally struck out in testing against the tumor cells. The anti-cancer properties of vegetables also seemed to be independent of their antioxidant content, suggesting that other chemical compounds were at work.

Indeed, the anti-cancer effects of cruciferous vegetables are no surprise. Previous research has found that broccoli and its botanical kin are high in compounds called glucosinates, which the body transforms into anti-carcinogens called isothiocynates. The best-known isothiocynate is sulforaphane, which comes from broccoli. Cruciferous vegetables may also help prevent hormone-responsive tumors, such as breast, prostate and ovarian cancers, via another naturally occurring compound, indole-3-carbinol (I3C).

Research on cancer-fighting properties of Allium vegetables is less extensive, but a 2006 Italian study found that consumption of onions and especially garlic was associated with a reduced risk of several types of cancer. Like cruciferous vegetables, garlic and related plants contain sulfur compounds thought to have anti-tumor properties.

“Since the formation of tumors is a random event that occurs in a significant percentage of the adult population,” Boivin concluded, “the increased consumption of these vegetables with high anticancer properties could play a… role in preventing these tumors from reaching a clinical stage and thus reduce the incidence of several types of cancers.”

True Fitness Is Deeper Than Superficial Vanity

If you’ve been following me for more than a few months – you’ll know that I have a different take on fitness success… I’ve said before, maybe in slightly different words – you eat well, and exercise not JUST too look incredible – but too feel your best and to ultimately live your life to the fullest, in all aspects.
When your body, mind and spirit are ‘tuned-in’ and well primed – everything you do is that much better. As a matter of fact, your potential to do more meaningful ‘things’ is tremendously enhanced and chances of success are greatly improved.

I know when I talk about fitness from the ‘mind, body, spirit’ angle – some people start to get the puzzled look on their face. But, it’s really not that complicated…

See, there’s a word that keeps coming up in some of the emails I get, some of the blogs comments people are leaving and in some of the posts in my private forum.


The word is Self Image.


Why do I bring self image into this conversation?

Because a healthy and vibrant self image is the easiest and strongest way to be in touch with your spirit. I’m not talking about an outwardly fake, offensively boisterous personality – I’m talking about the kind of self image that exudes confidence, happiness and a genuine appreciation for, and enjoyment of, “life”.

I’m a voracious reader. In the last 4 weeks I’ve torn through 3 fairly thick books. I have a never ending desire to learn – not just about ‘other topics’ relevant to my activities and business – but the desire to learn about “me”, the ’self’ – and in doing so, I learn about “you”. Let me explain…

In life, especially throughout childhood – the only information we have to go on is what we get from the people that are closest to us, such as family, friends and teachers (and unfortunately – the mass media).

I’m talking about the kind of information that molds, shapes and influences who we become as adults. Every generation has its own set of societal ‘ways of life’ – and digging deeper, we can see that different classes of society (lower, middle, upper, etc…) has its own subset of ‘ways of life’.

The deeper we dig, the more specific the ‘ways of life’ get – until you reach the level of ‘immediate (and nuclear) family unit’.


Let’s take my family, as an example.


My father came from Sicily when he was 13 years old, with the rest of his family. My mother’s parents came from Calabria – and gave birth to my mom in Brooklyn, NY. They all came to the US to give the future generations (me, my siblings, cousins, our kids, etc…) a better chance for success and a better way of life.

They taught us what they could, mostly by example – and some they tried to deliver in their own words. All of our grandparents were hard workers – tailors, seamstresses…

After serving in the US reserves (helo. medical rescue) – my father became a carpenter’s apprentice – and went on to become a master carpenter – capable of building just about anything. (He has since retired – and is now a Certified Personal Trainer, believe it or not).


The one thing I learned from my family is “work hard (I say ’smart’) and go after your dreams.”


But just like any other family – there are limitations on what you are capable of passing on to your offspring. There’s nothing wrong with this – it’s just a fact of life. And this is where the opportunity for self exploration and self education presents itself.


What do I mean by self education?


Simply put, it’s the material you learn outside of formal institutions such as schools, colleges – AND – outside of your familial ‘boundaries’.

Some people naturally tap into this – while others don’t even realize it’s there, waiting to be awoken.

I realized this in my teens – and I’ve been using (and refining) it ever since…

One of the easiest ways to do this is through books.

There are thousands of brilliant people who have walked this earth long before we did – whose writings will remain eternally true and infinitely helpful.

When I say brilliant – I’m not saying these people are any different form me and you. See, we are all pretty much given the same ‘tools’ when we are born. – What we choose to do with these tools during our life, COMBINED with the various influences in our life, is where the differences become evident.

One such book, which I’m reading right now, was originally written in 1960, by Dr. Maxwell Maltz. The title is Psycho-Cybernetics. Despite the fact that this book was first published in 1960 – it’s still a perennial bestseller. The primary reason being that this is a life-changing book.


This is one book I wish I found 20 years ago – But you know what I say… “It’s never too late.”


I think I’ve written long enough today – and I thank you for sticking with me. So I won’t go into a review of the book. You’ll be better served by just going to Amazon and getting a copy. Even if you can read 2 or 3 pages a day – you’ll be emailing me in a few weeks to says ‘thanks’ for recommending it.

And it doesn’t matter where you are in your life – this book is a valuable perspective on self image, self value and the realization of your ’self-potential’. Even if you’ve “accomplished all that you wanted – and are 100% happy” – the tools and lessons in this book will allow you to help those around you in ways you can’t imagine.
